Please read the following terms of use and disclaimers carefully before using this web Site www.WhereLegendsBegin.com. By accessing or using this site, you agree to these terms of use, conditions and all applicable laws. If you do not agree to these terms you may not use this Site.
Harassment in any manner or form on www.WhereLegendsBegin.com or any of the JaRySa LLC Websites, including via email and chat or by obscene or abusive language is strictly forbidden. Impersonation of others, including a JaRySa LLC employee, host, or representative or other members or visitors on the Site is prohibited. You may not upload to, distribute, or otherwise publish through the Site any content which is libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable, or which may constitute or encourage a criminal offense, violate the rights of any party or otherwise give rise to liability or violate any law.
You may not upload commercial content on the Site or use the Site to solicit others to join or become members of any other commercial online service or other organization. You may not download any portion of this site.
The person submitting any textual or pictorial submission understands, agrees, and declares the following.
1. The picture being submitted was taken by the person uploading the picture file and s/he has all rights and privileges to the picture and the picture file OR the person uploading the picture file is not the photographer but has obtained all rights and privileges to the picture and the picture file. The picture or the picture file is NOT copyrighted by another party and bears no 3rd party interest.
2. The picture contains no humans, nor material which is violent, pornographic or otherwise obscene, illegal or racially or otherwise morally offensive.
3. At the moment of submission, all Submissions (photographic and verbal/written) submitted to JaRySa LLC through email or through upload to WhereLegendsBegin.com or its subsidiaries, (JaRySa LLC Facebook Account, JaRySa LLC Twitter Account, CloudDwellers.blogspot.com, etc.) become the sole property of JaRySa LLC. By submitting your Submission, you grant JaRySa LLC an irrevocable royalty-free, worldwide right, in all media (now known or later developed) to use, publish, alter, or otherwise exploit your submission at will. You hereby forever release JaRySa LLC and any of its licensees from any and all claims you might have in connection with the use, exhibit, and sell of your Submission as set forth above. You also agree to sign (your parent or legal guardian if you are a minor in your state or Province) any necessary documentation to effectuate that license and release. Your Submission must be your own original work and, by submitting your Submission, you represent and warrant that: it is your sole original work; and you have obtained any and all consents, approvals or licenses required for you to submit your Submission (including obtaining the written consent of all 3rd parties, where applicable).
4. You agree to indemnify and hold harmless JaRySa LLC, its parents, subsidiaries and affiliated companies, each of their respective licensees, successors and assigns, and each of their respective employees, agents, representatives, officers and directors from and against any and all claims, losses, costs, damages, liabilities, losses, costs and expenses (including, without limitation, attorneys; fees) which arise out of any breach of this agreement or any of these covenants, agreements, obligations, rights, representations or warranties set forth herein. You waive any claim of infringement (including without limitation copyright, trademark, patent, trade name, trade secret, etc.) against JaRySa LLC or its licensees based upon access to or use of your Submission. If you do not want to grant JaRySa LLC the foregoing, please do not submit your Submission.
5. JaRySa LLC is not obligated to use your textual or pictorial submission and it will be deleted if deemed inappropriate. If and once posted, your textual and pictorial submissions may be deleted by JaRySa LLC at any time for any reason from any section of WhereLegendsBegin.com/TheCloudWhisperer.com. Anyone uploading objectionable picture files or objectionable text will have such submissions removed and may also permanently lose membership and its privileges. Upon loss of such membership and its privileges, any remaining pictures of value submitted may be retained on the site, even though the person who uploaded the pictures no longer has membership in the site nor any rights to monetary gifts associated with paid membership. (See paragraphs 3 and 4.) JaRySa LLC relies upon visitors to report questionable material and JaRySa LLC determines whether material is objectionable. The decision is based solely on the sensibilities and beliefs of the members of JaRySa LLC and its selected panel.
6. Any picture file uploaded to JaRySa LLC may be used in any form or format by JaRySa LLC on-line on any web site or off-line with no payment being made neither to the person submitting the picture file nor to the original photographer. As stated earlier, upon upload or email to JaRySa LLC, all picture files become the sole property of JaRySa LLC.
7. Anyone who uploads a picture or text gives JaRySa LLC the right to use the name of the photographer, as entered in the email text or upload form, in association with the file uploaded without any monetary recompense. That begin said, the name of the photographer or person submitting the picture file or text, may or may not be used according to the discretion of JaRySa LLC members and judges.
8. The membership status you acquire by default upon 'Sign Up' is free. You will receive none of the profits from the sale of the pictures, audio, or text you submit to JaRySa LLC/WhereLegendsBegin.com. You will have the satisfaction of submitting your pictures to JaRySaLLCpics@WhereLegendsBegin.com and watching to see if they are published and if so how the world reacts. You may also submit appropriate as described above text as you interact with other pictures.
Shipping and Handling
All items are shipped USPS Mail or UPS, unless otherwise specifically requested by purchaser and reflected in purchase price. Allow 4 to 6 weeks for delivery. In the event that an item is out of stock or backordered, we will not bill your credit card until the item is shipped to you. We do not ship over the weekend. Purchases will be delivered to the address you submit via the shipping form on WhereLegendsBegin.com. Below each picture on www.WhereLegendsBegin.com, the Shipping and Handling prices are listed next to the purchase price and are reflected in the total price in the shopping cart.
Refund Policy
There are no refunds. If upon arrival, you find your print has been damaged, you may return it to JaRySa LLC (JaRySa LLC, 3820 GA Highway 257, Dexter, Georgia 31019) within 30 days of purchase for a replacement print. Products kept for over 30 days without a return request are considered final. Customers are responsible for the cost of return shipping. JaRySa LLC will cover the cost for shipping to replace damaged prints. If there are any questions about returns, contact us at returns@WhereLegendsBegin.com and we will do everything possible to make sure you are satisfied. Before making a return, please email us at returns@WhereLegendsBegin.com in order to process the return.
